Terms and Conditions

Welcome to JustPix®. These Terms and Conditions ("Terms") govern your access to and use of the website located at justpix.com (the "Site") and all related services, including our custom print-on-demand products, artist marketplace, and creator program (collectively, the "Services"), operated by The Marketing Department Inc., operating as JustPix® ("JustPix," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to suspend or terminate accounts that we believe belong to individuals under 18.

2. Accounts

2.1 Account Creation

You may create an account to access certain features of the Services. You may also check out as a guest without creating an account. If you create an account, you may register using an email address and password, or through a third-party authentication provider (Google, GitHub, or Discord).

2.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials, including your password and any two-factor authentication methods. You agree to provide accurate and complete information when creating your account and to keep it up to date. You are responsible for all activity that occurs under your account. If you become aware of any unauthorized use, you must notify us immediately at support@justpix.com.

2.3 Account Deletion

You may request deletion of your account at any time by contacting us. Deleted accounts are soft-deleted (marked as inactive), and your email address will be freed for reuse. Certain data associated with your account, such as order history and financial records, may be retained as required by law. See our Privacy Policy for details on data retention.

3. Products and Orders

3.1 Product Descriptions

We make reasonable efforts to display product colours, dimensions, and details as accurately as possible. However, the appearance of products on your screen depends on your monitor settings, and we cannot guarantee that your display will accurately reflect the final printed product. Slight variations between screen representation and the physical product, including colour differences, are inherent to the printing process and do not constitute a defect.

3.2 Pricing and Currency

All prices are displayed in your local currency (Canadian Dollars or US Dollars), automatically detected based on your location. Prices are subject to change without notice. The price charged is the price displayed at the time your order is placed and confirmed.

3.3 Payment

All payments are processed securely through Stripe. We accept major credit and debit cards. Your payment card information is collected and processed directly by Stripe and is never stored on our servers. By placing an order, you represent that you are authorized to use the payment method provided.

3.4 Gift Cards

Gift cards are available for purchase and are delivered electronically via email. Gift cards are redeemable only for products and services on justpix.com and are subject to the following terms:

Non-refundable. Gift card purchases are final and cannot be refunded or returned for cash, except where required by applicable law.
No expiration. JustPix gift cards do not expire.
Currency-specific. Gift cards must be purchased and redeemed in the same currency (CAD or USD). A gift card purchased in CAD cannot be applied to a USD order, and vice versa.
Single-use code. Each gift card has a unique code in the format XXXX-XXXX-XXXX. Partial redemption is supported — any remaining balance stays on the card for future use.
Lost or stolen codes. We are unable to replace lost, stolen, or compromised gift card codes. Please treat your gift card code like cash.
Not combinable with certain offers. Gift cards cannot be used to purchase other gift cards. They may be combined with promotional discounts at checkout, subject to any restrictions on the applicable promotion.
Fraud prevention. We reserve the right to refuse, cancel, or reverse gift card transactions if we suspect fraud, abuse, or violation of these Terms.
Recipient delivery. Gift cards may be sent directly to a recipient's email address, scheduled for future delivery, or sent to the purchaser for personal delivery. JustPix is not responsible for undelivered emails due to incorrect email addresses provided by the purchaser.
Balance inquiries. You may check your gift card balance at any time during checkout by entering your gift card code.

3.5 Discount and Promotional Codes

Promotional codes are subject to their stated terms, including expiration dates, minimum purchase requirements, and product restrictions. Codes cannot be combined unless expressly stated. We reserve the right to cancel orders or revoke codes used in violation of their terms.

3.6 Order Confirmation and Processing

After placing an order, you will receive an email confirmation with your order details. This confirmation does not constitute acceptance of your order. We reserve the right to cancel or refuse any order for any reason, including pricing errors, product unavailability, or suspected fraud. If we cancel your order, you will receive a full refund.

4. Custom Uploads

4.1 Your Uploaded Content

The Services allow you to upload your own images for custom print-on-demand products ("Uploaded Content"). You retain full ownership of any images you upload.

4.2 License to JustPix

By uploading content to the Site, you grant JustPix a limited, non-exclusive, royalty-free license to reproduce, process, and print your Uploaded Content solely for the purpose of fulfilling your order. This license terminates upon completion of your order.

4.3 Content Responsibility

You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload and print the content you submit, that your Uploaded Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party, and that your Uploaded Content does not contain unlawful, defamatory, obscene, or otherwise objectionable material. We reserve the right to refuse to print any content that, in our sole discretion, violates these Terms or is otherwise inappropriate.

5. Shipping and Delivery

5.1 Production Time

Custom products are typically produced within approximately 3 business days from the date your order is confirmed and payment is received.

5.2 Delivery Estimates

Standard delivery is estimated at 5–7 business days after production is complete. Delivery times are estimates and are not guaranteed. Delays may occur due to carrier issues, weather, customs processing, or other factors beyond our control.

5.3 Shipping Carrier

Orders are shipped via FedEx. Tracking information will be emailed to you once your order ships.

5.4 Shipping Regions

We currently ship to addresses within Canada and the United States. We do not ship to P.O. boxes.

5.5 International Considerations

For orders crossing the Canada–US border, the recipient may be responsible for any applicable customs duties, import taxes, or brokerage fees assessed by their country. These charges are not included in the product price or shipping cost and are the responsibility of the recipient.

5.6 Shipping Information

To fulfill your order, we share your shipping details (name, email, phone number, and address) with FedEx. Your phone number is required by FedEx for delivery coordination purposes.

6. Happiness Guarantee — Returns and Refunds

6.1 Our Commitment

We stand behind the quality of our products. If your order arrives with a production defect, print quality issue, shipping damage, or other quality problem, we will work promptly to resolve the issue with a replacement or refund at our discretion.

6.2 What Is Covered

The Happiness Guarantee covers manufacturing defects (misprints, smudges, incorrect sizing), damage that occurred during shipping, and orders that arrive with the wrong product or artwork.

6.3 What Is Not Covered

Due to the custom, made-to-order nature of our products, we do not offer refunds or exchanges for preference-based reasons, including colour differences between your screen and the printed product, change of mind after ordering, or dissatisfaction with your uploaded image quality. We recommend uploading images at 300 DPI or higher for optimal print results.

6.4 How to Request a Resolution

Contact us at support@justpix.com within 14 days of receiving your order. Please include your order number and photos showing the issue. We will review your request and respond within 2 business days.

6.5 Refund Method

Approved refunds are processed back to your original payment method via Stripe. Partial refunds may be issued where appropriate. Refunds typically appear within 5–10 business days depending on your financial institution.

7. Artist Marketplace

7.1 Overview

The JustPix artist marketplace allows approved artists to upload original artwork for sale as print-on-demand products. The following terms apply to artists who are accepted into the marketplace. Artists must also agree to the standalone Artist Marketplace Agreement, which provides additional detail on licensing, tiers, payouts, and content standards. In the event of a conflict between this section and the Artist Marketplace Agreement, the Artist Marketplace Agreement controls.

7.2 Application and Approval

Artists must apply through the marketplace application process. Applications go through a review workflow (draft, processing, under review, and then either approved, rejected, or published). We reserve the right to accept or reject any application at our sole discretion.

7.3 Copyright and Ownership

You retain full copyright to your work. Participating in the marketplace does not transfer ownership of your artwork to JustPix. You are free to sell, license, or display your artwork on other platforms.

7.4 License Granted to JustPix

By uploading artwork to the marketplace, you grant JustPix a non-exclusive, worldwide, royalty-free license to display your artwork on the Site and in marketing materials (including paid advertisements on Meta platforms and other channels), reproduce your artwork on physical products for order fulfillment, use your artwork in promotional content (social media, email marketing, website features), and create thumbnails, previews, and other derivative formats for display purposes. This license remains in effect for as long as your artwork is published on the Site. You may remove your artwork at any time through your artist dashboard, which will terminate this license going forward, except for orders already in production and any marketing materials already in circulation.

7.5 Content Standards

All uploaded artwork must be original work that you have the right to license. Artwork must meet our minimum resolution requirements (300 DPI or higher). You may not upload content that infringes third-party intellectual property or other rights, is unlawful, defamatory, hateful, or obscene, contains trademarks or branding you do not own, or violates any applicable law.

We reserve the right to remove any artwork that violates these standards at any time and without prior notice.

7.6 Tier System and Earnings

Artists are placed into tiers based on rolling 90-day sales performance: Debut, Emerging, Rising, Gold, and Platinum. Each tier carries a multiplier that is applied to a base surcharge amount per product type. Your tier and multiplier determine your earnings per sale. Tier assignments are calculated automatically and may change as your sales performance changes.

7.7 Payouts

Earnings are paid out monthly via PayPal. You must provide a valid PayPal email address in your marketplace settings to receive payouts. You are solely responsible for any taxes applicable to your earnings.

7.8 Removal of Content

You may remove your own artwork from the marketplace at any time. JustPix may also remove artwork at any time for any reason, including violation of these Terms, changes to our content standards, or business decisions. If we remove your artwork, we will make reasonable efforts to notify you.

8. Creator Program

8.1 Overview

The JustPix creator program allows approved creators to produce original content featuring JustPix products and earn referral commissions. The following terms apply to participants. Creators who also participate in the artist marketplace are additionally bound by the Artist Marketplace Agreement, which includes the full creator program terms in Section 7.

8.2 Content Agreements

By joining the creator program, you agree to the following five terms:

Ad Usage. Content you create may be used in paid advertisements on Meta platforms (Facebook and Instagram) and other paid advertising channels.
Repurposing. Content you create may be repurposed by JustPix for future marketing campaigns.
Original Content. You will create original content photographed or filmed in your own space, without watermarks or third-party filters.
Evergreen Usage. Content usage rights are evergreen (perpetual) unless a different term is agreed upon in writing.
Raw Footage. You will provide raw footage and a clean MP4 file upon request.

8.3 Referral Commissions

Creators earn referral commissions on qualifying purchases made through their unique referral link. Attribution is tracked via a referral cookie placed on the buyer's browser. The duration of the referral cookie is configurable in your creator settings. Commission structure and rates are communicated during the application process and may be updated from time to time.

8.4 Termination

Either you or JustPix may terminate your participation in the creator program at any time. Upon termination, your referral link will be deactivated. Earned but unpaid commissions will be paid out according to the regular payout schedule. Content usage rights granted under Section 8.2 survive termination.

9. Intellectual Property

9.1 JustPix Property

The Site, including its design, text, graphics, logos, icons, the JustPix® name and trademark, software, and all other content created by JustPix (collectively, "JustPix Content"), is the property of The Marketing Department Inc. and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the JustPix Content without our prior written consent.

9.2 User-Generated Content

Artists and users retain ownership of the content they upload. The licenses you grant to JustPix are described in Sections 4, 7, and 8 above.

9.3 Copyright Infringement and DMCA

We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright, you may submit a takedown notice to:

Your notice must include an identification of the copyrighted work you claim has been infringed, an identification of the material on the Site that you claim is infringing (with a URL or sufficient detail for us to locate it), your contact information (name, address, phone number, and email), a statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law, a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf, and your physical or electronic signature.

We will investigate valid notices and take appropriate action, which may include removing the allegedly infringing content. We may also notify the user who posted the content and provide them with an opportunity to submit a counter-notice.

10. Prohibited Uses

You agree not to use the Services to violate any applicable law, regulation, or these Terms, upload or transmit content that infringes any third-party rights, upload content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable, impersonate any person or entity or misrepresent your affiliation with any person or entity, use any automated system, robot, scraper, or similar technology to access the Site for any purpose without our express written permission, interfere with or disrupt the Site or servers or networks connected to the Site, attempt to gain unauthorized access to any part of the Site or any systems or networks connected to it, or use the Services to send unsolicited commercial communications.

We reserve the right to suspend or terminate your access to the Services, without notice, for any violation of these Terms.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from the use of the Services will be accurate or reliable.

Colour Accuracy. Due to variations in monitors, screens, and printing processes, we cannot guarantee that the colours displayed on the Site will exactly match the colours of the final printed product. Colour variation is not considered a product defect.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE MARKETING DEPARTMENT INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO JUSTPIX IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

13. Indemnification

You agree to indemnify, defend, and hold harmless The Marketing Department Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Services, your violation of these Terms, your Uploaded Content or marketplace artwork, and your violation of any third-party rights, including intellectual property, privacy, or publicity rights.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

14.2 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at support@justpix.com and attempt to resolve any dispute informally within 30 days.

14.3 Jurisdiction

If a dispute cannot be resolved informally, you agree that any legal action or proceeding shall be brought exclusively in the courts of competent jurisdiction located in the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts.

14.4 Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Modifications to the Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email or through a notice on the Site. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

These Terms, together with our Privacy Policy, the Artist Marketplace Agreement (for marketplace participants), and any other legal notices or policies published on the Site, constitute the entire agreement between you and JustPix regarding your use of the Services and supersede all prior agreements and understandings, whether written or oral.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. A waiver of any default shall not constitute a waiver of any subsequent default.

19. Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
